This Indenture made the fourteenth day of April in the Twenty second year
of the reign of our Sovereign Lord George the Third by the Grace of God of
Great Brittain France and Ireland King defender of the Faith and soforth and
in the year of our Lord One Thousand Seven Hundred and Eighty two Between the
Right Honourable John Fitzpatrick Earl of Upper Ossory in the Kingdom of
Ireland and the Right Honourable Charles James Fox Nurles ? Guardians and
next of Kin to the Right Honourable Henry Richard Lord Holland Baron of
Foxley in the County of Wilts an Infant of the one part and Thomas Wirnham
of Bishopston in the County of Wilts labourer of the other part Witnesseth
that the said Earl and Charles James Fox as well in Consideration that the
said Thomas Wirnham hath procured a lawful Surrender to be made of a former
Indenture of Lease of the premises herein after mentioned bearing date
the fourteenth day of June One Thousand Seven Hundred and Thirty seven and
now in being for the remainder of a term of Ninety nine Years determinable
on the deaths of William Gray and Ann Gray as of the gum of three pounds
and three shillings of lawful money of Great Brittain to them in hand well
and truly paid at or before the exetion hereof the receipt whereof is
hereby acknowledged Have demised leased set and to Farm let and by these
presents Do demise lease set and to Farm let unto the said Thomas Wirnham
All that Cottage or tenement outhousing and Garden Ground containing Twenty
five perch therewith now held and belonging situate in Bishopston aforesaid
late in the possession of William Gray together with all Ways paths passages
Waters Easements prefits Commodities and Advantages whatsoever to the said
Cottage and premises belonging or in any wise appertaining Except out of this
present demise and lease all Trees of what nature or kind soever Mines and
Quarries now standing growing and being or which at any time or times hereafter
during the term hereby leased shall or may stand grow or be in or upon the
said leased premises or any part thereof together with full and free liberty
of ingress egress and regress for them the said Earl and Charles James Fox
their Heirs and Assigns to fell cut down dig up and carry away the same at
their Wills and Pleasures To Have and to hold the said Cottage and premises
with the Appurtenies ( except before excepted ) unto the said Thomas Wirnham
his Executors Administrators and Assigns from the date hereof for and during
and unto the full end and term of Ninety nine Years from thence next ensuing
and full to be compleat and ended if he the said Thomas Wirnham aged Forty
four years James Wirnham his son aged 6 Years and William Wirnham Son of
John Wirnham and Nephew of the said Thomas Wirnham aged 10 Years they or any
of them so long happen to live Yielding and Paying therefore Yearly and every
year during the said term unto the said Earl and Charles James Fox their
Heirs and Assigns the rent or Sum of Six pence of lawful money of Great
Brittain on two of the most usual Feasts or days in the Year for payment of
rent ( that is to say ) the Feast days of Saint Michael the Ark Angell and
the Annunciation of the blessed Virgin Mary by even and equal portions
without making any deduction defalcation or abatement out of or from the
same for taxes or any other reprizes whatsoever And the said Thomas Wirnham
for himself his Executors Administrators and Assigns doth Covenant promise
and agree to and with the said Earl and Charles James Fox their Heirs and
Assigns by these presents that he the said Thomas Wirnham his Executors
Administrators and Assigns shall and will well and truly pay or cause to
be paid unto the said Earl and Charles James Fox their Heirs and Assigns
the said Yearly rent in manner and form aforesaid and according to the
reservations thereof herein afore contained And also that the said Thomas
Wirnham his Executors Administrators and Assigns some or one of them shall
and will from time to time and at all times hereafter during the term hereby
leased at his and their own proper Costs and Charges well and sufficiently
repair uphold sustain maintain amend and keep the said demised premises
and every part and parcel thereof with the Appurtenancies in all manner of
needful and necessary repairations when and as often as need shall require
and the came premises so well and sufficiently repaired upheld sustained
maintained and kept at the end or other sooner determination of the said
Estate and term hereby leased which shall first happen shall and will quietly
and peaceably leave and yield up unto the said Earl and Charles James Fox
their Heirs and Assigns And also shall and will upon all and every reasonable
notice or warning give their Attendance at the Courst Baron or Customarv
Courts to be held of and for the Manor of Bishopston aforesaid and there be
ordered ruled and justified by and with the Steward and Homage of the said
Court and Courts for the time being in all things reasonable and shall and
will submit to and perform all and every such Orders and Bye Laws as the
Homage of the said Courts shall from time to time think fit to Ordain and
make for the better Ordering and Governing of the respective Tenant of the
said Manor And also shall and will pay all such reasonable Fines Pains
Penalties and Amerciaments as at any time during the continuance of the said
term hereby leased shall at any the said Courts be lawfully imposed presented
or set upon him the said Thomas Wirnham his Executors Administrators or Assigns
Provided always and these presents are upon condition nevertheless that if
the said Thomas Wirnham his Executore Administratore or Assigns shall not
within the space of Fourteen days next after the days and times herein before
limitted and appointed for payment of the said rent well and truly pay or
cause the same to be paid accordingly or if any wast or destruction shall
be done or committed or willingly suffered in or upon the hereby leased
premises or any part thereof to the Value of Ten Shillings and the same be
not compounded for or sufficiently amended within one month after notice
given Or if the said Thomas Wirnham his Executors Administrators or Assigns
shall not fulfill and perform all and every the Covernants and Agreements on
his and their parts and behalfs to be fulfilled and performed according to
the time intent and meaning thereof that then and in any or either of the
Cases aforesaid It shall and may be lawfull to and for the said Earl and
Charles James Fox their Heirs and Assigns into all and singular the hereby
demised premises or any part thereof in the name of the whole to enter and
the same to have again repossess and enjoy as in their first and former
Estate these presents or anything herein contained to the contrary thereof
in any wise notwithstanding And the said Earl and Charles James Fox do for
themselves their Heirs and Assigns Covenant Promise and Agree to and with
the said Thomas Wirnham his Executors Administrators and Assigns by these
presents that he the said Thomas Wirnham his Executors Administrators and
Assigns severally and respectively paying the rent thereby reserved in
manner as aforesaid and fulfilling and performing all and every the
Covenants and Agreemente on his and their parts and behalf to be fulfilled
and performed shall and may from time to time and and at all times hereafter
during the term hereby leased peacably and quitely have hold use occupy
possess and enjoy all and every the said premises with their and every
of their Apurtenancies ( except before excepted ) without the lawful let
hindrance molestation disturbance interruption or denyal of them the said
Earl and Cherles James Fox their Heirs and Assigns and all and every other
person or persons whatsoever claiming or to claim by from or under them
or any of them In Witness whereof the said parties to these presents their
Hands and Seals interchangeably have set the day and Year first above written.
